Bombay High Court Orders Rs 3 Crore Compensation in ‘Second-Hand Wife’ Domestic Violence Case
Mumbai(Mar, 31) : During their honeymoon, the husband struggled to utter the words “second-hand wife” when referring to his spouse, illustrating the discomfort and emotional weight of the derogatory term. Last Wednesday, the Bombay High Court upheld a lower court’s decision, ordering the payment of Rs 3 crore in compensation to the woman in a domestic violence case where she was subjected to such demeaning language.
Both individuals involved are educated, and the court emphasized the detrimental impact of domestic violence on the woman’s self-esteem. Affirming the lower court’s ruling, the High Court highlighted the absence of errors in the decision-making process. The persistence of domestic violence from 1994 to 2017 further justified the lower court’s verdict. In their legal battle, the American couple, both citizens, had challenged the lower court’s judgment in the High Court. Having married in 1994 and lived in Mumbai together from 2005, the husband’s departure to America in 2014 marked a turning point.
Their divorce, granted by a US court in 2018, was preceded by the wife’s filing of a domestic violence case in Mumbai in 2017, encapsulating a tumultuous chapter in their relationship.
